DMCA & Copyright Policy
Effective date: August 14, 2026. SocialMediaCircle (SMC) respects the intellectual property rights of copyright owners and expects SMCians to do the same. This policy explains how copyright owners can report material that they believe infringes their copyrights and how SocialMediaCircle handles valid copyright complaints.
This policy applies to content uploaded, posted, shared, linked, or otherwise made available by users through SocialMediaCircle.
1. Respect for Copyright
SocialMediaCircle (SMC) is a social platform where SMCians may create profiles, posts, discussions, groups, comments, images, videos, links, and other user-generated content. Users are responsible for ensuring that the content they upload or share does not infringe the copyrights or other intellectual property rights of another person or organization.
You should only upload or share content when you have the necessary rights, permission, license, or other lawful basis to do so.
2. Copyright Infringement Reports
If you believe that copyrighted material has been uploaded or made available on SocialMediaCircle without authorization, you may submit a copyright infringement notice to us.
If SocialMediaCircle receives a sufficiently complete and legally valid copyright notice, we may remove or disable access to the identified material and may notify the SMCian who uploaded or posted it.
3. What a DMCA Notice Should Include
A copyright infringement notice should contain sufficient information for us to identify the copyrighted work, locate the allegedly infringing material, and contact the complaining party.
- A physical or electronic signature of the copyright owner or an authorized representative.
- Identification of the copyrighted work that you believe has been infringed.
- Identification of the material on SocialMediaCircle that you believe is infringing, together with information reasonably sufficient for us to locate it, such as the URL or direct page address.
- Your name and contact information, including an email address and, where appropriate, mailing address and telephone number.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
These requirements are based on the elements specified in 17 U.S.C. ยง 512(c)(3) for a notification of claimed infringement. :contentReference[oaicite:1]{index=1}
4. Where to Send a Copyright Complaint
Copyright complaints should be sent through our copyright reporting contact:
DMCA / Copyright Complaints
SocialMediaCircle (SMC)
Email:
socialmediacircle.com@gmail.com
Please include all information necessary for us to identify the copyrighted work and locate the allegedly infringing material.
5. Review and Removal of Reported Content
SocialMediaCircle may review copyright complaints to determine whether they contain sufficient information to identify the allegedly infringing material and the copyrighted work at issue.
- We may remove or disable access to content identified in a valid copyright complaint.
- We may notify the SMCian who uploaded or posted the reported material.
- We may request additional information when a complaint is incomplete or unclear.
- We may decline to act on complaints that do not provide sufficient information to identify the material or establish the complainant's authority.
- We may preserve relevant records relating to a copyright complaint where reasonably necessary for legal, security, or operational purposes.
6. Counter-Notification
If your content was removed or access to it was disabled because of a copyright complaint and you believe the removal occurred because of a mistake or misidentification, you may submit a counter-notification.
A counter-notification should identify the material that was removed, explain why you believe the removal was incorrect, and contain the information and statements required by applicable law.
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number.
- The applicable jurisdiction and consent/service-of-process statements required by 17 U.S.C. ยง 512(g), where applicable.
A compliant counter-notification may result in restoration of the removed material according to the procedures and time periods provided by applicable law. :contentReference[oaicite:2]{index=2}
7. Repeat Copyright Infringers
SocialMediaCircle may restrict, suspend, or terminate accounts of users who repeatedly infringe copyright or other intellectual property rights.
Depending on the circumstances, we may also remove content, restrict particular features, or take other appropriate measures to prevent repeated infringement.
8. False or Misleading Complaints
Copyright complaints should only be submitted by copyright owners or persons authorized to act on their behalf.
Knowingly submitting false or materially misleading information in a copyright complaint or counter-notification may have legal consequences. Please do not use the copyright reporting process to settle unrelated disputes, harass another SMCian, or request removal of content that you do not have the legal authority to challenge.
9. User Responsibility
By uploading or sharing content on SocialMediaCircle, you represent that you have the necessary rights or authorization to use and share that content, or that your use is otherwise permitted by applicable law.
Copyright complaints do not replace a user's responsibility to comply with our Terms of Service and other applicable SMC policies.
10. Designated DMCA Agent
Service providers seeking the limitations on liability available under 17 U.S.C. ยง 512(c) must designate an agent to receive notifications of claimed infringement and make the required agent information publicly available. :contentReference[oaicite:3]{index=3}
